Who is affected?
In accordance with RD 208/2005 the following are described as electric and electronic device producers: regardless of the sales technique, including distance or electronic commerce, it includes individuals or legal entities that:

manufacture or sell electric and electronic devices, with their own brands, |
|
market devices manufactured by third-parties with their own brands, and |
|
- import or export from third-party countries. |
The classification will not include producers or distributors when the brand on the device is not a registered trademark of the said producer and is not registered in the Industrial Establishment Register, with a state scope, as described in the decree.
The individuals or legal persons who exclusively finance marketing operations will not be considered as producers, except when the said operations involve one of the activities described in the previous paragraph.
